The article analyzes the issues related to the formation of the concept of "customs crimes". The authors, not claiming to assess their reasoning as the only true one, invite to the discussion, and believe that the solution of the problems of determining the range of such illegal acts is possible by using a criminal law, but not a procedural approach. Normative sources from both the first and second areas are analyzed. The author definition of the term "customs crimes" is given. The applied focus of the present study gives the cast a specific list of prohibited criminal code acts that can be attributed to customs in the proper sense of this phrase (with articles and their parts, points).
