The article analyzes the legal nature of personal customs inspection, with an emphasis on the provisions of the Constitution of the Russian Federation on human rights and freedoms. During the study, gaps were identified regarding the existence of the legal concept of “personal customs inspection”, as well as the limits of inspection. In accordance with the provisions of the Constitution of the Russian Federation, it is proposed to fix these gaps in the form of a separate federal law, since the nature of personal search is closely related to the restriction of human rights and freedoms.
